May 12, 2016 Arizona HOA Legislation Update #13
On May 7, 2016, the Second Regular Session of Arizona's 52nd Legislature adjourned Sine Die. Any legislation still awaiting action by Governor Doug Ducey must be signed or vetoed by May 19, 2016, or will automatically become law.
A bill that the Governor allows to become law is effective on August 6, 2016, unless the bill contains a delayed effective date, emergency clause (effective immediately) or is an appropriation bill (effective immediately).
Below is the list of HOA specific bills and their most current status updates:
Planned communities; architectural designs; approval
Status: 3/30 Signed by Governor. Chapter 83, Laws 2016.
Homeowners' associations; enforcement grace period
Status: 5/7 Passed Senate 18-9; ready for governor.
Property; declaration amendment; procedure
Status: 5/6 House concurred in Senate amendments and passed on final reading 54-0; ready for Governor.
Regulatory boards; licensing; revisions
Status: 5/6 House concurred in Senate amendments and passed on final reading 34-20; ready for Governor.
Homeowners associations; director removal
Status: 5/7 Passed House 54-1; ready for Governor.
Homeowners associations; fees; hearings; elections
Status: 5/4 Senate concurred in House amendments and passed on final reading 29-0; ready for Governor.

Status: 2/17 Bill currently being held.
