outstanding violations, special assessments and insurance information, and allows the<br />
disclosures to be transmitted electronically. Requires HOAs to disclose title transfer fees,<br />
declarant control status, ownership concentration and certain purchaser acknowledgment<br />
statements regarding HOA obligations. Authorizes purchasers or sellers to pursue legal remedies<br />
if an HOA or owner knowingly or recklessly fails to provide required disclosures or provides<br />

a county assessor from conducting an on-site inspection of agricultural property for three years<br />
after the most recent inspection if the property meets agricultural classification criteria, unless<br />
the property owner files a change in use notice, the property is split, the ownership or lease of<br />

future revenues or common property. Requires HOA boards to act in the best interest of the HOA<br />
by exercising prudency in contracting, ensuring oversight of contractors, maintaining HOAcontrolled<br />
accounts, and reviewing financial reports. Requires surplus operating funds to be<br />
refunded or credited to owners or members unless a majority votes to transfer surplus funds to<br />

each petition at four distinct complaints. Authorizes administrative law judges (ALJs) to impose<br />
civil penalties of up to $500 per complaint or other statutory penalties. Requires a person to pay<br />
a filing fee to request a rehearing of an ALJ decision, and refunds the fee if the rehearing is<br />
denied.</p>

<p>Increases the delinquency thresholds that allow a condominium association or planned<br />
community association (HOA) to foreclose on a common expense lien to 18 months or $10,000,<br />
instead of one year or $1,200, and applies only the 18-month threshold for special assessments<br />
of $10,000 or more. Requires HOAs to maintain accurate account records that distinguish<br />
between charges included in the common expense lien and other member charges. Bars<br />
enforcement of charges assessed in violation of statute or governing documents. Allows a<br />
member to challenge any contested charge in court during an HOA action to enforce a common<br />
expense lien or judgment lien and requires the court to extinguish and exclude any invalid charge<br />
and related collection costs or fees from the lien.</p>

signal an emergency, is visible from the street and includes a low-light adjustment. Allows HOAs<br />
to adopt reasonable placement and lighting rules that do not impair the function, purpose, cost<br />
or efficiency of the device and that comply with municipal lighting ordinances. Requires a court<br />
to award reasonable attorney fees and costs to a party who substantially prevails in an action<br />
against an HOA board for violating these provisions.</p>

quorum requirements for annual and special meetings of an HOA are the same as regular<br />
meeting quorum requirements. Requires the HOA to reconvene an annual or special meeting to<br />
elect board members within 14 days if a quorum is not present, and to conduct the election once<br />
quorum is satisfied. Requires unit owners present to conduct meetings through motions decided<br />
by voice vote or show of hands, with the board facilitating and ensuring minutes are taken.<br />
Requires ballot actions to follow existing procedures, guarantees owners an opportunity to<br />
speak before votes, and establishes voting, roll call, and recordkeeping requirements for remote<br />
meetings. Requires the HOA board to present a financial and operations report at the annual<br />

each petition at four distinct complaints. Authorizes administrative law judges (ALJs) to impose<br />
civil penalties of up to $500 per complaint or other statutory penalties. Requires a person to pay<br />
a filing fee to request a rehearing of an ALJ decision, and refunds the fee if the rehearing is<br />
denied.</p>

least monthly while distinguishing resolved from unresolved violations and protecting personal<br />
privacy through redaction. Authorizes the State Real Estate Department or an affected owner or<br />
member through an administrative hearing to enforce compliance and to impose a civil penalty<br />
of up to $500 per month for noncompliance.</p>

Requires HOA boards to act in the best interest of the HOA by exercising prudency in contracting, ensuring oversight of contractors, maintaining HOA-controlled accounts, and reviewing financial reports. Requires surplus operating funds to be refunded or credited to owners or members unless a majority votes to transfer surplus funds to long-term reserve accounts.</p>

Requires ballot actions to follow existing procedures, guarantees owners an opportunity to speak before votes, and establishes voting, roll call, and recordkeeping requirements for remote meetings. <p>CONDOMINIUMS; COMMERCIAL STRUCTURES; RESIDENTIAL STRUCTURES</p>
<p>Requires that any common expenses in a condominium with separate commercial and residential structures be allocated based on the benefit to each structure. Expenses exclusively benefiting a commercial structure must be assessed only to the commercial units, while those benefiting a residential structure must be assessed only to the residential units. Expenses benefiting both structures must be proportionally allocated between them and assessed on a pro rata basis. Places the burden of proof on the condominium association to demonstrate compliance with these allocation requirements in case of disputes. Applies to all condominiums existing on or after the effective date of this legislation.</p>

<p>HOMEOWNERS&#8217; ASSOCIATIONS; BUDGET RATIFICATION; REQUIREMENTS</p>
<p>Requires the board of directors of homeowners&#8217; associations (HOAs) and condominium associations to develop and adopt annual operating budgets based on a reasonable and good faith estimate of anticipated common expenses. If the proposed budget results in an annual assessment increase exceeding the consumer price index percentage for the prior 12 months, it must be ratified by a majority of unit owners or members. Noncompliance with these requirements renders actions or assessments invalid. HOAs are authorized to establish reserve accounts to address anticipated long-term or major maintenance and upgrade of common elements.</p>

Requires all parties in litigation, arbitration, mediation, administrative action, or other claims to bear their own attorney fees and costs, except when the HOA&#8217;s governing documents allow a unit owner or member to recover such costs from the HOA.</p>

<p>Condominium and homeowners&#8217; associations (HOAs) that attempt to enforce unlawful provisions in their governing documents are liable for damages to the unit owner, in an amount of $1,000 for the first attempt to enforce, $10,000 for the second, and $100,000 for the third and subsequent attempts. Liability accrues regardless of whether enforcement is attempted against the same or different members. Grants unit owners and members the right to pursue damages in court.</p>

Allows associations to impose reasonable placement and lighting restrictions as long as they do not prevent, impair, or unreasonably increase the cost of the device.</p>

HOAs are authorized to establish reserve accounts to address anticipated long-term or major maintenance and upgrade of common elements.</p>

For latent defects or injuries to property discovered during the fourth year, actions may be brought within two years but no more than six years after substantial completion. These time limits apply to claims filed after the effective date of this legislation. Establishes requirements for condominium associations to initiate construction defect claims. The board of directors must secure approval by a 2/3 vote of unit owners before proceeding with legal action. Prior to voting, a registered professional engineer must inspect the alleged defects, and the findings must be disclosed to all relevant parties, including unit owners and developers. Associations must notify developers and construction professionals of the defect claims and provide them an opportunity to cure any defects after a favorable vote.</p>

The period of declarant control terminates two years, instead of four years, after all declarants have cased to offer units for sale, or 60 days after the effective date of this legislation for any HOA that satisfies listed criteria. Failure to terminate declarant control may result in civil penalties of up to $500. Establishes a list of duties that the declarant has to the HOA and unit owners or members during the period of declarant control. After the termination of declarant control, the declarant retains rights to develop, market, and manage remaining units as outlined in the declaration or plat, without interference from the HOA. The HOA cannot amend the declaration to impact these rights without the declarant&#8217;s consent and must maintain common elements to established standards. Control over the HOA transfers to the elected board and unit owners or members, and any restrictions on their authority are invalid. Violations of the declarant’s rights may result in civil penalties of up to $100 per day.</p>

<p>With 100 days in regular session, AAM will track bills pertinent to our industry and keep you informed.</p>
