February 4, 2016 Arizona HOA Legislation Update #2

House Bill 2172

Planned communities are prohibited from unreasonably withholding approval of construction project's architectural designs, plans and amendments.

Status:  Passed with all 9 votes by the Government and Higher Education Committee and forwarded to the Rules Committee.

House Bill 2513

A condominium unit owner cannot change the appearance of the exterior of a unit without the approval of a majority vote of the members of the condominium association, instead of being prohibited from changing the exterior appearance of a unit.

House Bill 2106

Homeowners' associations; enforcement grace period

Status:  Passed with 7 Ayes, 1 Nay and 1 Absent vote by the Government and Higher Education Committee and forwarded to the Rules Committee.

House Bill 2382

Except during the period of declarant control, the declaration may be amended by a homeowner's association or a property owner by an affirmative vote or written consent of the number of eligible voters as prescribed in the declaration. An amendment to a declaration may apply to fewer than all of the lots or less than all of the property that is bound by the declaration, and the amendment is deemed to conform to the general design and plan of the community if specified conditions are met. And amendment to the declaration is effective immediately on recordation of the instrument in the county in which the property is located.

Status:  Assigned to House Judiciary Committee.

Senate Bill 1088

Secured residential communities; process servers

Status:  Passed with an amendment by the Public Safety, Military and Technology Committee and forwarded to the Rules Committee where it was declared "Proper for Consideration" and will now go to the Committee of Whole (COW), after which will go to the Senate floor for vote.
